Organizer Terms of Service

1. Acceptance of Terms
By creating an Organizer account, checking the "I accept the Terms of Service and Privacy Policy" box during registration, or otherwise using the RapidFundraising Fundraising LLC ("RapidFundraising," "we," "us," "our") website, platform, and services (collectively, the "Service"), you agree to be bound by these Organizer Terms of Service ("Terms").
These Terms apply to Organizers—individuals responsible for creating, managing, or overseeing fundraising campaigns on behalf of an organization (e.g., booster officers, coaches, band directors). By accepting these Terms, you represent that you have the authority to bind the organization you represent ("your Organization") to these Terms. Separate terms govern Participants (e.g., students, parents, guardians) who join campaigns.
Our Data Promise
All personal information and supporter data entered into RapidFundraising is used solely for the purpose of operating your Organization's fundraiser. We do not reuse, repurpose, sell, rent, or share your data or your supporters' data for any other purpose—including marketing, advertising, analytics unrelated to your campaign, or any other commercial use. When your campaign ends, your data is not recycled into other campaigns or shared with other organizations. See our Privacy Policy for full details.
Binding Agreement
Acceptance of these Terms constitutes a binding agreement between you (individually and on behalf of your Organization) and RapidFundraising. Checking the acceptance box during registration has the same legal effect as a handwritten signature.
We may update these Terms at any time by posting revised Terms on the Service with an updated "Last Updated" date. Continued use after posting constitutes acceptance of the revised Terms.
2. Account Registration
To use the Service as an Organizer, you must create an account by providing your name, email address, phone number, organization name, and a password. By registering, you agree to:
- Provide accurate, current, and complete information about yourself and your Organization;
- Maintain and update your information to keep it accurate;
- Keep your password confidential and not share your account credentials;
- Accept responsibility for all activity that occurs under your account;
- Notify us immediately of any unauthorized access to your account.
Accounts are for individual use and are non-transferable. RapidFundraising reserves the right to suspend or terminate accounts that contain false information or violate these Terms.
3. Services Provided by RapidFundraising
Upon acceptance of these Terms and creation of your campaign, RapidFundraising will provide the following services:
- Operation of your Organization's online fundraiser via the RapidFundraising platform;
- Overall fundraiser setup, documentation, training, and support (including text messages, phone calls, meetings, and emails) pertaining to the operation of the fundraiser;
- Creation of a customized online fundraising campaign hosted on RapidFundraising infrastructure;
- Creation of and training on donation reporting within the platform;
- Donation and pledge management training and support;
- Fundraising operations support, including supporting donors.
4. Payment and Fund Distribution
Pricing and platform fees are presented and agreed to during the campaign setup wizard. By completing the setup wizard and launching your campaign, you accept the pricing terms displayed at that time. This section governs how funds are distributed to your Organization.
4.1 RapidFundraising-Collected Donations
If your Organization uses RapidFundraising to collect donations on your behalf, funds will be distributed to your Organization within 30 days (NET 30) of the completion of your fundraiser. RapidFundraising will provide a final accounting at the conclusion of the campaign.
4.2 Organization-Managed Payment Processing
If your Organization uses its own payment processing platform (e.g., your own Stripe account), donation funds are deposited directly to your account according to your payment processor's standard schedule. RapidFundraising does not hold or handle these funds.
4.3 Donor-Sponsored Campaigns
If your Organization selects the donor-sponsored option, donors may choose to cover platform fees at the time of their donation. Under this model, the net amount your Organization receives per donation is the donation amount minus the credit card processing fee, plus any platform fees the donor elected to add. RapidFundraising does not guarantee that donors will choose to cover platform fees; if a donor declines, applicable platform fees will be deducted from the donation amount as outlined during campaign setup.
4.4 Gross and Net Donation Amounts
When your Organization chooses to have RapidFundraising collect donations on your behalf, all donations are processed through Stripe. The gross donation amount is the full amount the donor submits. The net donation amount your Organization receives is the gross donation amount minus Stripe's credit card processing fees. These processing fees are set by Stripe and are not controlled by RapidFundraising. Current Stripe processing rates are available at stripe.com/pricing.
For example, if a donor contributes $100 and Stripe's processing fee is 2.9% + $0.30, the net amount deposited to your Organization would be approximately $96.80.
If your Organization uses its own Stripe account (see Section 4.2), processing fees are deducted by Stripe directly from your account and RapidFundraising is not involved in the transaction.
4.5 Platform Fee Invoicing
If your Organization selects a per-student or percentage-based pricing model during campaign setup, RapidFundraising will issue an invoice for the applicable platform fees at the conclusion of your fundraiser. Payment is due within 30 days (NET 30) of the invoice date. The invoice will detail the pricing model selected, the number of active Participants or total donation volume (as applicable), and the total amount due.
4.6 Collection Costs
If RapidFundraising must retain legal counsel to collect any portion of fees owed, you agree that RapidFundraising is entitled to recover the amount owed plus 20% of the outstanding balance as reasonable attorney's fees and costs.
5. Organization Status and Representations
During campaign setup, you will be asked to indicate your Organization's tax-exempt status. By selecting the applicable option, you represent and warrant either:
- (a) Your Organization is a current tax-exempt nonprofit entity in accordance with the laws and regulations of its jurisdiction of incorporation and intends to maintain such designation; or
- (b) Your Organization is not currently a tax-exempt nonprofit entity.
You agree to notify RapidFundraising of any change in your Organization's tax-exempt status within 30 days of such change by emailing curtis@rapidfundraising.com.
Supporter Communications
Automated supporter communications (SMS reminders and emails sent on your Organization's behalf to supporter contacts) are available by default to verified nonprofit organizations. Non-nonprofit organizations may authorize these communications separately during registration. See Section 6 for details.
6. Your Obligations as Organizer
By accepting these Terms, you agree to the following responsibilities:
- SMS and Email Communications Consent: You authorize RapidFundraising to send text (SMS) messages and emails to Participants for the purposes of: (i) managing their fundraising accounts (e.g., account setup, password resets, login access); (ii) encouraging active participation in the fundraiser (e.g., reminders to add contacts, share links, and engage supporters); and (iii) providing campaign updates and progress notifications. You also authorize RapidFundraising to send system-generated SMS messages and emails on your Organization's behalf and in your Organization's name to supporter contacts provided by Participants, for the purpose of encouraging donations. The supporter communication authorization applies only if your Organization is a verified nonprofit or has separately authorized supporter communications during registration.
- Organization SMS Opt-Out: Your Organization may opt out of the automated SMS reminder program at any time by notifying RapidFundraising at curtis@rapidfundraising.com. If your Organization opts out, RapidFundraising will also inform Participants in your campaign that SMS reminders have been disabled. Please note that opting out of SMS reminders may reduce Participant engagement and campaign effectiveness, as automated reminders are a key driver of fundraising results.
- Minor Participants: RapidFundraising offers two ways for Participants to join a campaign: Connect accounts (which require the Participant to create an account on the platform) and Express participation (which does not require account creation). If any Participant using a Connect account is under the age of 13, you will ensure that a parent or legal guardian creates the account on that Participant's behalf. Connect Participants ages 13–17 must have parent/guardian involvement in account setup and supporter data entry. The minor age restriction does not apply to Express participation, as no account is created.
- Participant Engagement: You agree to encourage Participants to be active in the fundraiser. The success of your Organization's campaign depends directly on Participant engagement.
- Incentive Program: You agree to design and share an incentive program for Participants to encourage participation.
- Content: You agree to provide campaign content (such as organization description, logos, and messaging) for use on the RapidFundraising platform.
- Kickoff Support: You agree to provide volunteers for any Blitz or Kickoff event associated with your campaign.
SMS Authorization Details
By accepting these Terms as a nonprofit organizer, you authorize RapidFundraising to send supporter communications on your Organization's behalf. Non-nonprofit organizations may provide this authorization separately during registration. Your Organization may opt out at any time by contacting us.
7. RapidFundraising's Commitments
RapidFundraising agrees to the following:
- No Data Reuse: We will not reuse contact information entered into the platform for any reason other than encouraging donations for your Organization's specific fundraiser.
- No Data Sharing: We will never share contact information with any person, company, or organization not necessary to operate the Service (see our Privacy Policy for the limited service providers we work with).
- Data Access: We will provide you with all contact information entered by Participants and all donor contact information upon request.
- Data Retention: We will retain data from your fundraiser in our databases for a maximum of 1 year after the fundraiser ends, after which it will be securely deleted.
- Account Cleanup: We will remove all Participant accounts created for your campaign after the fundraiser is complete, for security purposes.
- Invoicing: We will provide the final invoice at the agreed conclusion date of the fundraiser.
Our Data Commitment
Your data stays yours. We don't reuse it, share it, or recycle it. When your campaign ends, we clean up. Period.
8. Supporter SMS/Text Messaging Program
RapidFundraising sends optional SMS updates to supporters added by Participants in your campaign. As the Organizer, you authorize these communications on behalf of your Organization. The following rules apply:
- Opt-in Required: Supporters will only receive fundraising texts after explicitly opting in (e.g., by replying YES to a consent request). No fundraising texts are sent without explicit opt-in.
- Two-Step Consent: First, the Participant attests they have permission to provide the supporter's number. Then, the supporter must explicitly opt in before messages are sent.
- Message Frequency: 3 max per campaign.
- Cost Disclosure: Message and data rates may apply.
- Opt-Out / Help: Supporters may reply STOP to unsubscribe; HELP for help; START to re-subscribe. Opt-outs are processed immediately.
- Quiet Hours: Messages are sent only between 8:00 a.m. and 9:00 p.m. local time.
- Consent Not a Condition: SMS consent is not required for a supporter to make a donation.
- Identification: Messages clearly identify RapidFundraising and/or your Organization.
RapidFundraising maintains a full audit trail of all messaging activity, including timestamps, opt-in/opt-out records, and Twilio MessageSIDs, retained for TCPA/CTIA compliance.
Sample Opt-In Message:
"Message from RapidFundraising: Hi Sarah, Jackson Martinez with Band ABC invited you to get fundraiser updates. Reply YES to subscribe, STOP to opt out. Msg&Data rates may apply."
Sample Fundraising Message (after opt-in):
"Band ABC Update: Help Jackson reach his goal! Donate: [link]. Reply STOP to unsubscribe. Msg&Data rates may apply."
9. Confidentiality and Data Use Limitation
RapidFundraising does not own the personal data or supporter contact information provided by you or your Participants. All data entered into the Service is used exclusively to operate and administer your Organization's specific fundraising campaign. We will not:
- Reuse or repurpose your data or your supporters' data for any unrelated purpose;
- Share supporter contact lists with other campaigns, organizations, or third parties;
- Use your data for our own marketing, advertising, or promotional purposes (except as permitted under Section 10);
- Build profiles of your supporters for use outside your campaign;
- Retain or recycle data into future campaigns unless you explicitly authorize it.
We handle all nonpublic information with reasonable care, using safeguards consistent with those applied to our own confidential information. For full details, see our Privacy Policy.
10. Marketing and Client Identification
By accepting these Terms, you grant RapidFundraising permission to identify your Organization as a RapidFundraising client on our website and in marketing materials. This is limited to identifying the relationship (e.g., "Band ABC is a RapidFundraising client") and does not include sharing any supporter data, campaign financials, or personal information.

11. Ownership and Intellectual Property
RapidFundraising retains ownership of the Service, including all software, designs, platform content, and associated intellectual property rights. Nothing in these Terms grants you any ownership interest in the Service. Campaign content you provide (logos, descriptions, messaging) remains your property.
12. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND PERFORMANCE, RELIABILITY, OR AVAILABILITY. NO ADVICE OR INFORMATION PROVIDED BY RAPIDFUNDRAISING SHALL CREATE ANY WARRANTY. THE SUCCESS OF YOUR ORGANIZATION'S FUNDRAISER DEPENDS ON PARTICIPANT ENGAGEMENT AND IS NOT GUARANTEED BY RAPIDFUNDRAISING.
13. Indemnification
You agree to defend, indemnify, and hold RapidFundraising harmless from and against any and all claims, controversies, losses, liabilities, expenses, costs, or damages (including reasonable attorney's fees) arising from:
- Breach of any representation, warranty, or obligation under these Terms;
- Providing supporter data without proper consent;
- TCPA, CTIA, or other regulatory violations caused by your or your Participants' misrepresentations;
- Unauthorized use of the Service;
- Any third-party claims linked to your Organization's use of the Service.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS OR DATA; AND (B) OUR TOTAL LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE TOTAL FEES PAID BY YOUR ORGANIZATION TO RAPIDFUNDRAISING UNDER THESE TERMS IN THE 12 MONTHS PRECEDING THE CLAIM.
15. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of Texas.
- Jurisdiction: Exclusive jurisdiction lies with the courts in Williamson County, Texas.
- Arbitration: Either party may elect binding arbitration under AAA rules, conducted on an individual basis. No consolidation with other claims is permitted.
- Interim Relief: Either party may seek interim court relief to protect rights pending arbitration.
16. Term and Termination
These Terms are effective from the date you accept them and remain in effect through the completion of your Organization's fundraiser and full payment of all fees owed. Provisions that by their nature should survive termination (including indemnification, limitation of liability, data retention commitments, and governing law) will survive.
RapidFundraising may terminate your access to the Service immediately upon written notice if you materially breach these Terms. Termination does not relieve your Organization of any payment obligations for services already rendered.
17. Entire Agreement, Severability, and Waiver
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the full agreement between you (and your Organization) and RapidFundraising regarding your use of the Service as an Organizer. These Terms supersede any prior written or verbal agreements between the parties.
- Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.
- Waiver: Our failure to enforce any right or provision is not a waiver of future enforcement.
- Binding Effect: These Terms are binding on the heirs, successors, and assigns of both you (and your Organization) and RapidFundraising.
